The  GST for man power supply is  18%  and the service has been removed from the list of items requiring payment by receiver by reverse charge mechanism. Hence the service provider has to include the GST in his bill, claim from the receiver and pay to the Government and the same is eligible for input credit.

Yes.  If a Service Receiver avails manpower supply from an unregistered service provider, the reciver has to pay under RCM but it is eligible for input credit.  However, since the receivers will try to avoid services from unregistered service providers as the GST of 18% will be on total man power cost including the wages, they  may not have sufficient out put tax liabilty to set off the input credit in which case it will be an expense/liability for the receiver.  Hence it is better that all man power service providers to  register for GST.

Our Man Power Supplier is not registered with GST. We are Paying Manpower charges 9k per month. whether do we need to pay the RCM GST? or else Provider has to register and after getting the GST number we need to pay the Tax amount?

His busineess Turnover would be around 30 to 35 laks?  If he register, whether will he get the Input credit or not?

There is no reverse charge for normal man power payment under GST if he is a registered supplier. Services availed from unregistered supplier attracts 100% reversre charge and you may have to take the burden including wages along with his service charges in full. However it is eligible for ITC and if you have equal output tax payable you may adjust. It is better ask him to register or shift to a registered supplier and pay him GST alongside with wages.

Dear sir,

IF I have one service( security service) some states of  india. But I have 1 register office in west bengal , will required GST in separate state? some companies pressure for separat GST . As per rule we can service bill in interstate basis, kindly reply i will be obliged.

Yes. It is necessary to have separate registration for each state. A given PAN based legal entity would have one GSTIN per State, that means a business entity having its branches in multiple States will have to take separate State wise registration for the branches in different States as the State Code identifies the Place of Business, Since the registration is online, you may easily register for multiple states with the same set of documents.

I AM MAN POWER SUPPLY I HAD COLLECTED GST ON MANPOWER SUPPLY CHARGES AND PF & ESI EMPLOYER CONTRIBUTION .  MY POINT IS PF & ESI STATUTORY PAYMENT BUT I AM CHARGE TO GST .

3. Request you to confirm treatement in case of where services received from Unregistered Manpower Service provider, liability of GST payment on Service Receiver ? & Input Credit of Such GST paid under RCM to Service Receiver

We are taking man power service from a party. All PF/EPF is in our scope and they charge to us only service charge. both are registered.

Now question is that:

1)Whether GST wil be charged to Employee PF ? Yes/No (Right now GST is not levid on Employee contribution)

1) Whether GST will be charged to Employer Contri. in PF? Yes/No
