I am entering into an agreement to buy a flat from Landlord allocation under Joint Development agreement between landlord & Promoter/ Developer. The Completion certificate is yet to receive, My question is whether I need to pay GST to landlord, landlord being an individual person not obtained GST registration.

If the agreement is directly made with land-owner with specific condition, GST will not be levied,
But when tri-party agreement made along with builder, GST will be levied by builder.

thanks sir, in nutshell it is to be specified in the sale agreement that GST wont be borne by the buyer .
