Hi..
ABC Ltd got civil contract for residential project from XYZ Ltd.
ABC limited handover the project as per the agreement between, at the time of making final bill by ABC Ltd to XYZ Ltd, ABC Ltd also claim damages charges towards delay in project at the end of XYZ Ltd for not providing necessary approvals on time.
My query is whether ABC limited have to pay GST on the claim? if yes, when we need to deposit the same.
In terms of schedule 2 (5)(e)
[e] agreeing to the obligation to refrain from an act, or to tolerate an act or a situation, or to do an act; and
Hence its supply & GST is applicable
Note : There is also Advance Ruling : Maharashtra Authority for Advance Ruling ("AAR") in the case of Maharashtra State Power Generation Company Limited ("Applicant")
