Gst 5% on property

I have booked a flat in Jan 12, 2019 . Builder told me then GST will be 12%. I gave him some amount in cheque. He gave me received but that time we both not made any agreement.

Now Govt reduse GST date 12% to 5%. My question is how much GST applicable on my case 12%or 5% if now I will go for registry and made agreement with builder.

Interested to know as wel, what the provision and rules are... 

 

In general supply under GST, rate applicable at the time of raising of invoice is used... 

The rate 5% GST is going to be effective from 1/4/2019 when the Govt notify it by issuing Notification.

Hence as of today it's 12%
so can they wait for the purchase of under construction building for lower purchase value

I DONT THINK SO.... BECUASE IN CONSTRUCTION SERVICES (FOR PARTICULAR PROJECT) THE BUILDER WOULD HAVE ALREADY CLAIMED ITC SO HE IS NOT LIABLE TO CHARGE 5% GST

refer sec 14 of cgst act, change in rates. the applicable rate depends on 3 factors:
date of invoice
date of payment
date of provision of supply
he can avail the scheme of 5% GST if the project has been completed to 32% by the end of the FY.
