Gratuity

if i have worked for a company for 4 years 8 months then am i elgible to get gratuity........?

When is Gratuity Payable as per Payment of Gratuity Act 1972

Gratuity is payable to an employee when an employee leaves employment after completing at least five years in service with an employer
Gratuity is payable to an employee on the termination of his employment after he has rendered continuous service of 5 years on his superannuation or on his retirement or resignation or death or disablement..
how ever condition of 5 years doesnot apply if termination of employment is due to death or disablement....
so if u work for 4 years and 8 months u r still not entitled to gratuity unless u r disabled..
