As you have already served for a period of around nine months with your principal, you are justified in claiming the credit of your articleship period served during this period.
Now, the legal implications are:
as per the Chartered Accountant Rules, it is the primary responsibility of a chartered accountant to check whether he is eligible to train an article or not. As a chartered accountant is bound by the said act and rules. Hence, primafacie your principal is deemed to guilty of professional miscounduct.
Now, the practical solution is:
You should request your principal to register yourself under a different chartered accountant, who will be eligible to train you, and request him to register you as an article from December, 2009. The implications are that you have to pay some penalty for late filing of Form 102 and 103.
