 The Delhi High Court on Thursday directed  the Institute of Chartered Accountant of India (ICAI) to provide students with certified copies of answersheets under the Right to information Act.

Justice S Ravindra Bhat dismissed contentions raised by the institute that answersheets fell beyond the purview of the RTI, holding that students were well within their rights to access them.

ICAI is an institute. You should apply pragmatism and set examples for others. You should start by yourself... Many institutes do that and allow students to inspect their copies,” Justice Bhat told the ICAI, which had challenged a Central Information Commission verdict to provide certified copies of papers to students who failed the exams.

Additional Solicitor general Parag Tripathi, appearing for ICAI, submitted that the Supreme Court in its order of 2007 rejected the candidates’ right to demand answersheets.

Really it helps the CA students a lot. They can analyze himself by checking his own copies. They can improve a lot in such a way.

Yes, This is totally possible. 

I am very glad that this topic has been covered here. Find attached a copy of the order of the Central Information Commission ("CIC") that was challanged by the ICAI before the Hon'ble High Court of Delhi.

I do not currently have a copy of the order of the High Court of Delhi, since I was not made a party to that writ petition. It should be available on the website of the delhi high court soon.

The other information, refused by the Hon'ble CIC ie. model answers & instructions issued to examiners (written & oral) and discretion used by the institute vide Regulation 39(2) [regulation that empowers the institute to arbitrarily reduce marks of any candidate or class of candidates to mantain a pass percentage], is currently sub judice. I have challanged that by way of a writ petition before the Hon'ble Bombay High Court. This hearing is scheduled before the High Court of Bombay on 29th June, 09. Those in Mumbai may attend.

The Supreme Court has held that, if there is an error in correction, or an error in the question paper a student can file a writ for reassessment, of the papers. (Refer Ayan Das v/s West Bangal - 2007)

I appeared for my final CA exam in November' 07. There was one question carrying 8 marks which was wrongly printed (FM paper) & there was another question carrying 8 marks which was incorrect. (And, I did not pass in aggregate, I got exactly 384 out of 800)

Once, I determine whether I have been marked for these questions, and whether I have been marked correctly for other questions, I may challange the result itself.
