Form 5 inv filing

Under Investor Education and Protection Fund (Uploading of Information regarding unpaid and unclaimed amount lying with companies) Rules, 2012 companies are required to file 1 form 5 INV each year for furnishing complete information on unpaid and unclaimed amount lying with the Company as on the date of AGM of that year.

 

However, it has come to the notice of Ministry that the Companies have filed multiple forms 5 INV. To remove this and to clear the doubts, not it is clarified :

  1. Any company which has filed multiple form 5 INV for uploading the information for the year 2010-11 on or before the date of issue of this circular, should again file form 5 INV and upload the details of investors in excel sheet. The process should be completed upto 31st August, 2012.

 

  1. All Companies, which have not yet filed form 5 INV are allowed to file form 5 INV along with details of investors in excel template upto 31st August, 2012.

We had filed form 5 INV twice for 2010-11. coz first form was showing status 'rejected', so we uploaded same again but meantime first form's status changed to 'approved' & then automatically second form got rejected.  So my query is whether we still require to file form 5INV for 2010-11?

Primafacie you have completed the process one form is approved and extra filing got rejected.

 

However, in veiw of the above circular and to remove the doubt, i suggest you to file form 5 INV again.

We had filed Form 5 INV by 31st July. What should be the last date to upload the excel template? Would it be within 14 days from the date of filing Form 5INV or 31st August?

My company is a private limited company. We had received share application money in 2011-12. We have refunded the share application money in 2013-14. For 2012-13 we have recd notice from MCA.

What should we do
