Rules for cost audit is yet to be notified , so we should wait for rules to notified or proceed with filling of 23C for F.Y 2014-15 as the panelty for non filling of 23C is quite heavy. Pls give your valuable suggestion.

Hello ,
Everyone is awaiting for the Clarifications on the appoinment of cost auditor since long.
It is very surprising that SUCH TYPE OF time barred clarifications are not taken on prioity by MCA.
hope , it comes soon before the deadline.

Section 148 of Companies Act 2013 has been notified which does not provide for approval of CG for appointment of cost auditor. However, Rules under this Section are yet to be notified. President of Cost Accountants Institute has also taken up this issue with MCA:

In view of this, there is no need to file Form 23C now for 2014-15.

It is very clear. There is no need to file Form 23C. Form 23C refers to 1956 Act and these provisions are no more applicable now.

on raising the complaint / ticket to MCA , we got following message for the query on filing 23c for the year 2014-15
"" Dear Sir/Madam,
Kindly refer the sections notified in place of the old sections as this form shall remain on the site till new form is notified by the ministry.""

yes , we were not reqd to file the form 23c.
it was really a logical solution of the problem given by sir n mam ,
thanks once again , as you both have given the new avenue to my thoughts and the direction that how one should seek the logical solution of the problem .
