Appointment of WTD u/s 198, 269,309,310 of CA'56 requires form 23 to be filed after his appointment. query: 1. it is to be filed after the board mg. where his appt. is made and the draft sevice agreement was approved? OR 2. It is to be filed after the P.Ballot or GM ? 3. If answer to 1 is yes then should the agreement be attached? or to be attached to form to be filed after approval of the members? 4. Form 23 is filed for registration of special resolution. So it is file after GM

If u want to register the agreement as well then attach it in the same Form 23

u r getting me wrong.

pl. also note that F/23 is for registration of resolution and agreement and not only for special res.

my query is that if a resolution is passed for the appt. of the WTD in the board mg. with approval of his service agreement, subject to the necessary consent and approval, then shall I file form 23 after board mg. with attachment of the agreement. ??

the resolution passed at the GM will have to be registered via F/23? in that case whether the agreement to be attached??

IN OTHER WORDS

When shoUld the resolution of his appt. be registered through F/23 - after board meeting or after GM? with or without the service agreement?
