My client has received salary of 10 lacs in FY 18-19.Above amount of 10 lacs is showing in Part-B of Form-16.
However wrong amount of 12 lacs is showing in 26AS as well as Part-A of Form-16.
Salary actually received is 10 lacs only.
ITR has been filed considering the income of 10 lacs only.
Now he has received notice from IT Dept u/s 139(9) for Defective Return.
What should be the way forward in such case as the company in which the client was working has closed down.

The notice is rightly received. Because Income Tax Department will consider 26AS/ Form 16 amount only.

As the employer company has been closed down, you are left with option of writing to AO and submit a complain for furnishing wrong Form 16 .

If revised return you file then additional tax interest will have to be paid by you.

Now it's your call to catch hold of employer for correct Form 16 urgently.

1. IT department will only take form 16 and 26AS statement for cross verifying your income declared in IT return.
2. Approach the AO in writing and make sure you specify the difficulty.
3. If possible approach the company for revision of TDS returns with the correct amount of salary.
Please correct me if the above solution has an alternative view.
