31 May 2012If an employee does not get form 16 from the employer for f.y. 2011-12 then how can am employee file income tax return? Further Employer has not paid salary for last some months & deducted tds but not deposited so in this case what can he does and what is the liability of an employee?

Pls file a case fist in your nearest consumer cout for your salary. Its very easy & small process
You will surely get your all money & In the part of FORM 16 employer has to deposit the TDS & file eTDS return otherwise you would not get credit of the respective TDS

Salary has to be credited. If not then you should file a complaint agst your employer.
The employer has to deposit the amount deducted as TDS into the govt's treasury and upload the TDS return als. He is also defaulting in the same.
Ask your employer for compliance of the procedures as early as possible so as to avoid litigations and penalties.
