Hi all,

Its a pvt Ltd co. We have appointed one new director on 01st of May 08. Can he put signature on form16 for the FY 2007-08

If the date of Form 16 is prior to 01st May, 2008, since it is to be issued immediately after the closure of financial year, the new director can not sign the form. Since there will be another director, presuming a continuing director, since minimum number of directors required is 2, the other director can sign the form. Also if any other person who is in charge of taxation, can be authorised to issue the form 16 and sign on behalf of the company.

yes ,Board can authorise one or more person to sign form 16

it is no matter that director is appointed in AY 2008-09

Form 16 can be issued by any person authorised....whether a Director or a person specifically entrusted with the responsibility... it has nothing to do with date of appointment.
