If i file Individual income tax return after 31st july and before 31st march will it be covered u/s 139(1) or 139(4)....?Eg i want to file return of PY08-09 on 15th Dec09.

u/s 139(4) .... as it is not filed within d due date...
As this is late return, it will be covered under 139(4).
