Is there provision in VCES scheme of service tax to file st3 returns which have not been filed. In my case we have obtained service tax registration but since there was no working we did not file any return. Can we file Nil ST3 return now without any penalty or late fees under the present VCES scheme.

The VCES Scheme is for payment of tax dues. Hence benefit for waiver of penalty for non filing of ST-3 (though NIL) is not covered by VCES. However Rule 7 of Service Tax Rules, 1994 provides for waiver or reduction in penalty for non-filing of NIL ST-3 returns. Waiver/reduction of penalty can be granted by the Central Excise Officer.
