can f-8 (creation of charge) requires the DSC of the chargeholder ( in my case the Bank) at the time of uploading the same on MCA. So i would like to know whether its possible to file form 8 without the DSC of the Bank ?
what is the remedy in case the bank refuses to sign the form? Is there any legal obligation put through on the chargeholder to certify the form by the Companies Act, 1956? |

DSC of Chargeholder is mandatory for e-filing Form8.. widout that the form cant be uploaded.
if bank refuses then the bank is creating problem for itself coz in statutory audit, the auditor will qualify in his report.. Practical solution is that u shud convince for filing form8.. even then they r not agree den just take a letter from bank manager for the same under rubber stamp f bank so that if u get ny query from ROC, den u can justify the ground because of which the company was not able to upload e-form.
