Hello..

One of My client's TDS is not credited for the AY 2013-14 even though it is deducted from his salary.  He changed his job and has not received his FORM 16 also.He needs to file return. So,what is the procedure? How can he file his returns without TDS credit?

Employee is responsible to get Form 16 from the employer though he is not with that employer.

Form 16 otherwise credit in 26AS is compulsory to get credit. It can't be demonstrated before Assessing officer that the deduction was made only for TDS purpose

Write to your employer (MD) and ask them to immediately issue form 16. Talk to the accountant informally in that company and ask whether they intend to give form 16 or intends to just keep you waiting till you give up. Accordingly, you can decide your next course of action.
