Foriegn company is liable to FBT only if it had an employees based in India...if company had not an employee base in india he is not liable to FBT...
Refer circular no. 8/2005 of CBDT....

Mayank is right. Finance Ministry has issued circular no. 8/2005 of CBDT containing a list of around 105 Questions with answers which covers almost all the queries.
