Hi,

I failed to file ITR for the AY 2011-12. What should I do?

The total income for that year, as per form 26AS, is around Rs.2,10,000, of which 1,68,000 was from my previous employer and they had deducted tax of around 5.8k. The next company's salary was around 45k and they did not deduct any taxes (i had worked here for only a month).  Hence it is shown as 'Provisional' against the last company's salary. Please direct me what to do.

Since the income relates to ay 2011-12 , you cannot file return now. Calculate and pay balance tax if any. If you have no other income then employers tds already covers your tax liability. There is nothing more to do. If ypu receive any notice from the department regarding this year then you can submit the details

Based on the Form 16 given by the first company, net tax payable is zero. Hence I assume they have exempted HRA from tax.

1) Since the second company did not deduct any TDS, I should pay tax for the salary from the second employer (10% of Rs.45000 = 4.5k), right?

2) I read about sections 234A, E and 271H in which IT dept can penalize me as follows. Please correct my understanding..

234A:  4.5k*1%*48 months = 2.16k (assuming I file it in June 2015, 4 years delay)

234E: 4.5k (200 per day or TDS, whichever is lower)

271H: minimum of 10k up to 1 lac.

The whole thing is scary.. If the above is true, please tell how to file the tax return since there is no such option on income tax website.

You worry about only 234 A (& 234B & C if applicable)

and also 271 F , which AO can levy. You may ignore rest

 

Contact CA of your local area. There is no such option at income tax site because such a return can not be filed online

Chill maro boss because u can not file return of a.y. 2011-12 because u can file return date 31/3/13. So u can not file return of income. Dont worry about that only penalty 5000 can be levied. But in practically AO have no time for such small return so sab bhagwan pe chod ke so jao

Yes u can file your retrun against notice.

now your question is still to date not received notice.

So, Ready your Retrun and give it in ASK department by select u/s 139(9) retrun after due date.

You will not even liable for penalty.
