Export benefit in service industry

Dear All, One of my Client is provide Engnineering Consultancy service outside india i.e. USA, Europe, Qatar etc (Export Service). My Query 1. Whether DGFT has provided any Export Benefit to Service Industry. Since in Mfg industry they provide various export promotion scheme (i.e. DEPB license/ Advance License/Country Specific benefit)? 2. If Yes! Let me the process and procedure for application to be made at DGFT. Will be greetful if any one provide there expert advise. Thank You

DEAR SIR,

THEY ARE ELIGIBLE FOR AVAIL SERVE FROM INDIA SCHEME (SFIS) SCHEME  AUTHORISATION  AT THE RATE OF 10% ON FREE FOREIGN EXCHANGE EARNINGS  FROM THE DGFT.

Hello Sir, I had gone through the SFIS Scheme w.r.t to transfer/Saleable or not, The wording Says that "Transfer of duty credit scrips/goods imported under the scheme shall be allowed within service providers of the Groups Company and managed hotels, with actual user condition." My Further Query is on the basis of above word: Whether Duty Credit Scrip can be transfer/sale to Group/Sister Concern company and they can used for payment of excise duty or import duty Thank you Very Much

AS PER  PARA NO. 3.12.7 OF FOREIGN TRADE POLICY 2009-2014 , ENTITLEMENT / GOODS (IMPORTED/ PROCUDERED) SHALL BE NO.- TRANSFERABLE (EXCEPT WITHIN GROUP COMPANY& MANAGED HOTELS) AND BE SUBJECT TO ACTUAL USER CONDITION.


SFIS scrip can be transferred to group companies. but they can use the same for procurement of  capital goods for service business and not for manufacture.

other scrips such as FPS, FMS can be freely traded in the open market..

actually The Status Holders Incentive Scrip Scheme (SHIS) was announced in the Foreign Trade Policy 2009-14.

SHIS provided additional Duty Credit Scrips to Status Holders @ 1% of the FOB value of past exports, which can be used for procurement of capital goods with Actual User condition. This facility was available for sectors of leather (excluding finished leather), textiles and jute, handicrafts, engineering (excluding Iron & steel & non-ferrous metals ) etc.,   This scheme  which was valid for exports only during two years 2009-10 and 2010-11, has  now been extended by one more year for 2011-12 exports also.

 

Base on above discussion whether engineering consultant company can sale duty credit scrip to his group company who is a service industry say it software company. This IT company can utilise duty credit scrip only for capital asset for payment of excise or custom duty or revenue expenditures whether manufacturing company can used this duty credit scrip.
