expiry date of e way bill

Recently Gst inspectors inspected parcel agents godown in kerala and found a bale of uncleared textile consignment. The related e way bill date had expired. The consignee explained the delay (one week) and refused to pay the penalty(of 10%). Consignors (intra state)explained that proper invoice and eway bill had accompanied the goods and there has been no revenue loss. The matter is unresolved. Please advise
