Excise rebate

Dear All,

We have taken excise refund under Rule 18 of CER 2002 and Notification No.21/2004 CE (NT) dated 6.9.2004. and DEPB Benefits as well against exported shipment.

Now, we have claim Duty Draw Back against exported dispatched as DEPB is closed. Kindly let me know that we can apply for excise refund under Rule 18 of CER 2002 and Notification No.21/2004 CE (NT) dated 6.9.2004.

21/2004 CE(NT) specifies the rebate of duty on imputs used, to be exported under notification no 42/2001 CE(NT)

while the rule 18 prescirbes the rebate of duty read with notification no 40/2001CE(NT)

both can not be performed at single time, so you have to opt for any one of above.

read the ARE-1 clauses appended at bottom of ARE-1, which were filled at the time of clearance, and you will get your status clear with the declaration made at the time of export of goods.
