20 March 2013Hi one of our client has made excess payment of interest on service tax can we adjust the said amount of excess payment towards any other amount due from the assess or can we adjust the same against the service tax liability of subsequent quarters. i gone through sub rule 4A and 4B of rule 6 but it talks about the service tax amount and not about any other payments.

There is no provision as such for adjustement of excess interest paid on service tax, However it can be adjusted with the interest liability falling under same return period.i.e half yearly returns. If u have paid excess interest for the month of may than you can adjust this interest with interest payable for other months till Sept.
Otherwise you need to file a Refund claim.
