Excess cenvat credit is available in our account

Dear Sir,

 The Assessee can claim Refund of Un-utilised (Accumulated)  Cenvat Credit under Cenvat Credit Rule 5 against export .

Is it possible to claim refund of Un-utilised Cenvat Credit against Deemed Export ie sale to EOU against CT- 3 ? What is the procedure and documentation is required for such refund ?

hello sir.in my company there is a balance of cenvat credit which is unutilised. audit party is of opiniob that such unutised balance is termed as income and is taxable.i am against it..plz give the correct solution.

pay duty against export to EOU , and claim refund on the strength of ARE1/3 from department. against CT3 its not possible
