ESI provisions apply if such persons are performing their duties at intervals for couple of days, but repeated in month or year at several times.
if the painter job is incidental and they never came to resume work after the specific work then you have to disclose that during inspection, but if they found it with records that same person is deputed for same job at regular or irregular intervals for several repeated times during the year, then they will treat it as employee and claim for contribution on such workers.
