Epcg redemption for deemed export.

We have got epcg benefit of 'concessional duty 03%' percent back in Oct 2011 for installing new machinery.

Export period is 8years (6+2). And value should be Eight times of duty saved.

We sold goods on H-form as deemed export to another party in 2014 and assumed our obligation is over and didn't filed any documents with custom office till April 2015(big mistake).

Later on, in 2017, we approached for redemption of our epcg with Pune office, but it was rejected. Again our accountant tried in Pune office and this time the authority said you didn't filed in timeline and again rejected.

Proof I have-

1. Form h ( serial no)

2. Multimodal transportation document (MTD no)

3. Schedule B -Details of regarding export bill of lading details (having h form serial number, my company name, and MTD no in bill of lading details table)

 

What should be the procedure now to redeem our epcg obligation. And which officer we need to approach in Pune office

Deemed exports can be well considered as completion of obligation for EPCG. The reason that appliation has been rejected may be for the reason of nom filing periodical returns as per FTP.

It is better to hire a consultant well versed in DGFT to file neccesaary applications and close the issue to avoid heavy penalty and refund of duty saved amt with interest
Thanks for your info. Thats what I was thinking and the penalty is bothering me. How can I find some good authentic consultant for it in Pune. Can I find on this forum. (My local consultant just wasted time).
