Hello Members,

Please let me know the Eligibility criteria for Income Tax Return Filing.

Suppose a Female has annual income of 96,000/- per year & have PAN Number.

As per the Tax slab the income is definitely not falling under the Tax Slab. Is it necessary to File the ITR even if it is Zero(0)?

What is the outcome for the non filing of ITR in such case.

In your case, there is no need to fil return.

But if your client has TDS Credit, then she can file return and claim refund. Interest u/s 234A wil be applicable to those assessees who comes under the relevant tax slabs. Since her income is only rs.96000 section 234A wont be applicable.

The filling is mandatory only when the income exceed the taxable limit. Currently, the limit for women assesees is Rs. 190000/- ( before claiming any deduction under chapter VIA) for assessment yr. 2010-11.

Dear Friend AS per Income Tax Rules if Income of Assesse have income more than the limit of Nil Rate have compulsion to file Income Tax Return For eg. A girl has income income of Rs. 2,40,000 and have deductions u/s 80c is 60,000 = N.T.I = 1,80,000 and another girl have income of Rs 1,85,000. In this case first girl have to file her return but in second case its choice (no compulsion). Regards

i guess need to go thru the sec 139(1) where it is clearly given tha ift the income of a person(s),subject to sec 10 exceeds maximor amount not chargeable to tax shall equired to filling the return under sec 139(1).

If Gross total income is taxable than assess must file return, else no need to file.

but Govt.of INDIA wants everyone to fill return, whether your income is taxable or not, just because this Increase the no. of return filler in INDIA, and for world concern its needed. It increase the reputation of INDIA among other countries.

one reason is, we get loan from other countries and from world banks on behalf of the no. of return filler. so if we will file our return means we are helping INDIA to get loan and other facilities. :)
