Hi Mohan,
The assessee can claim exemption u/s 10(14) for education allowance given by the employer and can claim deduction u/s 80C for tution fees paid, simultaneously.

Hey Mohan...I hope the following explanation shall clear ur doubts....
u/s 10(14)... exemption is given on the basis of a notional amount set by the lawmaker...(as sometimes its difficult to have proof of tution fee payment)
but u/s 80C...deduction is given for any amount on the basis of proof of fee payment....there is no notional amt set...

yes Mohan he can claim the deduction, But he has to show the proof as a receipt of tutition fees given by the school or the institution.

Yes, he can claim both deduction. But the assessee has to provide proof for tution fee paid.

Yes he can claim
and more int. thing in this type of cases is education allowance can be avail if no children is studying because its fixed without any expenditure just like u take benefit of 30% of NAV in Income of House Property (without expending) same as here
and also Transport Allowance is allowed Rs. 800 if not expending even if employee live in the same factory where he do work and getting Allowance its exempt
so Education Allowance is exempt

Dear mohan,
Children education expenses like tution fee paid can be allowed as deduction as per sec-80C.
One more important point to remember is that payment must be made to college,university,school and other educational institution situated within india towards full time education of any two children. Dept-circular.
