Due date extension

 All Gujarat Federation of Tax Consultants vs. CBDT, Special Civil Application No. 15075 Of 2015, Dated-15.09.2015

 After Punjab & Haryana High Court the Gujarat High Court also directs CBDT to extend the due date for Filing of ITR to October 31st in its Judgement today. The case was argued by Saurabh Soparkar. 

However it is advisable to wait for CBDT's order regarding extension of due date since CBDT might approach SC and take a stay against the HC order.

Hi Rinkal,

Finality comes when circular is issued by CBDT itself. No order of court can be substituted i presume. And there are many difference in opinion as to whether HC order can be applicable all over India. Moreover it is a direction given to CBDT and CBDT can alone release circular to this effect. Everyone has to wait for CBDT circular only.

That is what I meant. Read the entire article posted. I posted it as an update. Also I clarified that CBDT order is awaited. I did not mention that due date is extended.

It is very well said in the post that HC have directed to extend the due date.

But final consideration has to be taken only when cbdt issues the same. 

I know the fact that only when cbdt will issue the circular will that be considered valid.

Anyways thanks for interpretating in different way. Maybe I must have used complicated words which might have required you to think differently.
