Dear Experts,

Can you please explain how much salaried employees can avail the Driver salary exemption per month and under which section.

I have received from my employer that I can avail Driver salary reimbursement upto Rs.25000/- per month and Rs.3,00,000/- per year.

And also they have mention as car maintenance reimbursement of Rs.2,500/- PM and Rs.30,000/-Per year.

Please let me know your opinion on this.

Thanks and Regards,

Hi Parameshwar,

Regarding driver salary exemption and car maintenance reimbursement, here’s a clear explanation based on Income Tax rules:

1. Driver Salary Reimbursement:

  • When an employer provides a chauffeur or driver, the salary paid to the driver by the employer is generally not taxable in the hands of the employee.

  • This is because the driver is considered to be employed by the employer for business or official purposes.

  • However, if the employer reimburses the employee for the driver’s salary paid personally, the amount is usually considered a perquisite or allowance and taxed as salary income unless exempt.

2. Exemption Limits:

  • There is no specific Income Tax Act section that explicitly caps driver salary reimbursement at Rs. 25,000 per month or Rs. 3,00,000 per year.

  • Such limits are usually employer’s internal policy or part of company’s salary structure, not statutory.

  • So, the amount mentioned by your employer (Rs. 25,000 per month and Rs. 3,00,000 per year) is likely a policy cap on reimbursement for driver salary.

  • For tax purposes, if reimbursement is part of salary, it will be taxable unless specifically exempt.

3. Car Maintenance Reimbursement:

  • Similarly, car maintenance reimbursement (e.g., Rs. 2,500 per month or Rs. 30,000 per year) is also governed by employer policy.

  • If the employer reimburses expenses incurred for official or personal use, this may be taxable as perquisite unless exempt under specific rules.

  • Usually, if the vehicle is provided for official use, the value of perquisite is taxable, and maintenance reimbursement may or may not be exempt depending on usage and policy.

4. Relevant Income Tax Sections:

  • Section 17(2): Defines perquisites.

  • Rule 3: Valuation of perquisites including motor vehicle.

  • Section 10(14): Certain allowances exempt from tax but does not specifically mention driver salary.

Summary:

  • There is no direct statutory exemption for driver salary reimbursement limits; amounts reimbursed as part of salary are taxable.

  • Your employer’s limits are internal policy caps and may help control taxable benefits.

  • For personal clarity, check with your employer’s HR or tax consultant how these reimbursements are treated in your salary slip and Form 16.
