Disqualification of Director

A company is striked off by ROC for non-filing of financials for a period of two years, whether directors will be disqualified in this case or not as time limit u/s 164 is of 3 years. What will be the implications of such strike off upon the directors?

Answer In simple is- The Directors of defaulted company shall be disqualified by virtue of Sec 164.

Answer in elaborated manner is -
As per sec 164(2)-
Company shall file Form DIR-9 immediately furninshing name and address of the Directors if company failed to file FS, Annual returns.

When company fails to file Form DIR-9 within 30 days of such failure it would attract the disqualification u/s 164.
