We are planning to register a LLP company ( < 1Lakh) One of the Designated partner is a NRI ( indian residing in USA ; NOT foreign National in India)

As per the Rules, both of the DP are required to get DIN in order to incorportae. DIN asks for Address proof of an NRI which needs to be verified. Per the Govt website it can be verified by

Consulate of the Indian Embassy OR CEO / Managing director of the Indian company in which he / she proposed to be a director.

its not practical to ask Indian Embassy to attest a address verification document for a company investing < 1 Lakh.

Secondly there is no "CEO/MD" of the Indian company to attest as the company is not yet formed.

Question :

Who practically can do the verification of address proof /other docs of our NRI designated partner in USA

Dear Esteemed Experts ,

I heard that it is not possible for an NRI to get a (LLP) company Registered without her/his physcial presence in India; even if they can get Digital Signature. is that so that his/her physical presence is mandatory? Is there a way we have an NRI register a company in India remotely ?

Secondly if it is possible, who can do the Verificationof documents like identity proof and address proof.

Look forward for the experts to answer these questions.

Hello Sir,

Please note that for DIN, you would require Photo identity and address proof.

If the person you are referring to has an indian passport, you can get it attested from a CA/CS/CWA and submit it to obtain DIN, It would prove to be both identity and address proof

There won’t be any issues regarding that..
