Difference between G.R. date and billing date

Dear Friends,

We are availing G.T.A. Services and take credit. We have sent material on 22.02.2009 and bill charged by Transporter on 15.03.2009. What will be the S.tax rate 10% or 12%. Service Tax has been changed from 24.02.2009 from 12% to 10%.

Though there is a doubt and no clarity in this reagrd, the date of payment maybe more relevant. This is the principle adopted fro central excise

Dear ram,

For charging service tax date of billing is not important.

The period over which you have provided the service is important.

If your service (trasportation) has been rendered before 24th then irrespective of date of billing service tax @ 12% would be applicable and if you have provided the service on or after 24th s.t. @ 10% would be applicable.

The same view has been upheld in respect of some service provided over a period of time like coaching classes
