Consequence of wrongly assigning Designation of AO in Return

ITR 3179 views 3 replies

Friends,

While e-filing the return I have wrongly quoted the designation of AO as (ITO, Ward-1), while for this year the assessees gross income being more than 5 lakhs ( after deductions u/s 80C Net taxable income is Rs 4,36,000), i must have quoted the AO as (ACIT)?

What is the consequence of this?

Is it a blunder?

Whether I have to file the revised return..

Please help me out guys..

You have filed correctly with ITO who is already receiving your case. As the AC will also be in the same ward / circle / range, he will transfer it to the AC. Suppose your income was 4 lakhs and you file with ITO. He sends notice u/s 143(2) and during scrutiny adds 1.1 lakhs to your income. His order will have to be also confirmed by the AC having jurisdition on you.

It is better you apply to the ITO to transfer the case to the AC if you are feeling so uncomfortable.

I think, you need not worry for assigning wrong designation of AO in IT return. As now all the return are being processed at a Centrallised Processing Centre, the ward/circle mentioned in the return may not be a relevant. At present the PAN will be with the ward/circle where you had filed your return. While processing the return, the PAN should be transferred to concerned ward/circle of correct jurisidition and to be processed. If it is a refund case, getting of refund may be delayed. Otherwise there will be no issue in this regard.

I have filed my tax returns 2012-13 assessment year by e-filing, in that software/system chosen the ward based on the current address, which is JCIT- Range 12, Hyd but before that I was living in Bangalore and earned all my income in bangalore but I have moved to Hyd now. In all my previous returns (physical filing), it was specified as DCIT/ACIT CIR 14(1). I have huge refund.

I have noticed that my e-filing acknowledgement has this new jurisdiction JCIT- Range 12, Hyd. When I have talked to a trp, she said that I dont need to refile, tax filing software/system always chooses the jurisdiction based on the current address and since it is e-filing all returns are processed at Bangalore, I dont need to do anything.

Is this correct? please clarify.

In e-filing I have mentioned my current address as hyd but on incometax india website my address showing as Bangalore.

please advice on the steps that I need to do. I sincerely appreciate your time in answering this.
