GST ITC on room tariff

hi,

my company is registered in kerala. one of my employee went to Karnataka for Business purpose and he use to stay in a hotel and they charged sgst and cgst for the room tariff. I have registration in Kerala only .. So how can i claim ITC against this ... please advise..

As per my personal opinion, you not able to get ITC because you have to tell at the of billing charge IGST.

yes hotel will charge u Cgst/SGST, as place of service where the hotel is situated, so can't take input.
Moreover he cannot put Ur GSTn in his bill as u registered in Kerala, & the service provider is in Karnataka

plz book gross amount in expenses

No input GST can be claimed as your company doesn't have registration in Karnataka. The Hotel as booked GST because the place of supply is where the service is provided, that is Karnataka

So kindly book the CGST and SGST amount as your expenses

You can't get the itc in this case. Take it as an expense. There is no movement of service happening in this case, so they can't charge igst.

Then that hotel mentioned our gst number in the invoice. how they can file gstr with cgst and sgst split with our Kerala gst number.. how it will affect my gstr ..
he will find difficult in filing his return GSTR1, as it will not accept Cgst/SGST on the GSTn of other state , so need worry, ask him to delete Ur GSTn in his invoice.

plz take the changed invoice by him on mail or other means

No worries. They are karnataka registered people so they are collecting karnataka sgst. It won't affect your gst return. Take the whole amount as an expense.  smiley
