What is status of company in MCA portal.
Whether it is Dormant company or active company.
If it is dormant co. File GNL-4 or if not file annual forms or any other forms asusual.

You can file the forms with penalty. Without any issues.

I have doubt regarding auditor appointment. i.e. file ADT-1 today for period 2013 to 2016 and file same with normal filing fee

Sir,
You need to file two forms for appointment of auditor.
As per companies act,1956, Auditor can be appointed for one financial year only,(2013-14) - First form
But after notifing the new act, auditor can be appoointed for five years subject to ratification in every AGM.(2014-2019)- Second form
For both the forms challan including penalty is 7800+7800

Actually I was trying to figure out something to lower the penalty but that seems impossible.
