My cousine brother is an employee in tata motors he has an income around 9.2 lakhs. Recently his father heart operation in aaims and total expenditure around 5 lakh, tata motors reimburse 3.90 lakhs and remaining 1.1 lakh bear from his own pocket, on 3.9 lakhs tata motors deduct 30% Tds my query is there any deduction in IT act to claim thise expense

Since Tata motors have deducted TDS @ 30% they have considered this amount as salary. If you want to claim this deduction you need to admit this income in your return and then claim deduction as per rule.

Sir there is no provision to claim the deduction of amount expended on medical treatment..

However as per my understanding the entire receipt of Rs. 3.90 Lakhs is tax free in first place. hence there is no question of deduction.

As per Section 17(2) any sum paid by the employer in respect of any expenditure actually incurred by the employee on his medical treatment or treatment of any member of his family in any hospital maintained by the Government shall be tax free.
