We started our business in India. now we had one of the foreigner investor to invest in my co. can u suggest the procedure to be followed.

NRI's can invest in private company by way of issue of equity shares or Preferential shares or Debentures

Tell me the procedure to be followed

First of all see whether the FDI is permissable under FEMA regulations. FDI is permitted in 100% of sectors

Then decide upon whether Equity, preferential or debentures are to be alloted.

Then the amount to be transfered has to be done via a NRO Account or NRE account.

Apply to RBI in form FNC 7 for purchase of shares by NRI
