Import of second hand semi-trailer (hs code 8716 3900

Hi,

 

I am looking to import a refurbished semi-trailer (the trailer which is connect to trucks which are used to transport sea containers). I spoke to DGFT and was told that new or refurbished is counted in the HS Code specified (i.e. 8716 3900 with basic duty of 10%) unless I import it as scrap. 

I had read that the import of second hand capital goods can be free if authorized. Can I classify this under capital goods ( it will be a capital good for me). Also, can any specify what documentation I need to provide to authorize the import. I would be interested in availing the services of anyone who can assisst me in the same.

I am currently unsure of whether the import will be as per the HS code (at 10%) or any other with 0% duty as per the DGFT circular.

If you want to import second hand goods to India, It should be categorized in capital goods.

Duty would be 10%, can not be 0%,

Further you need to have a correct value declaration from a chartred engineer.

Zero duty EPCG scheme allows import of capital goods (including CKD/SKD thereof as well as computer software systems) for pre-production, production and post-production at zero Customs duty, subject to an export obligation equivalent to 6 times of duty saved on capital goods imported under EPCG scheme, to be fulfilled in 6 years reckoned from Authorization issue-date.

Thank you for the information. Unfortunately my import cannot be placed in the EPCG scheme as my exports are bare minimum.
