01 August 2013My company is a trading company working under a brand . For business promotion we purchase T-shirts from some outside party with our brand name written on it. We distribute these T-shirts free of cost to our clients and customers.
Now my q is that whether TDS is applicable or not on payments made to T-shirts vendor.

It is merely a supply transaction. Though it has been customized according to your requirement by printing ur brand name it won't be classified as work u/s 194C in which case TDS will be applicable unless you have given him the material for supplying the t-shirts according to your requirement.

Not only producing the good as per customer specification, but also supply of material, if any, should be provided by the client to attract provision of TDS u/s 194C.
