My assessee is a local authority they deducted tax at sources @ 2% on subcontractors and they paid to the department also. the subcontractors pan was error, now Department raised the demanding order for levying 20% higher tax,is there any decided cases in favour of assessee

how can save my tax..my total salary is rs760000 nd tds is 70000 I don't have any investment except 150000 80c please advise

no need to revised just go to traces site n online correct Pan detail......

Dear Sunitha,

Online or Manual uploading correction is called as revising the return. Please login to TRACES site with company/deductee/your account, request for TDS statement correction for particular quarter, open and select PAN correction option, will find default PAN's list, select what you want to change to correct and submit correction, the demand will clear in 24 working hours.

Now I'm giving practical problem. My assessee is a govt orgn. it is given contract work to different person before 4 to 5 years. Now they are not traceable, TDS officer has raised the demand notice, now we are thinking to go for an appeal. My que is, is there any saving provisions or decisions in this regard. Now revising of tds retruns is not possible.

 

if tds not paid by other party no way u have to pay tax + interest 

Hi Sunitha, So please check once again about that 4-5 years back TDS entry, Is it taxable or not? If the correct PAN is not traceable you have to show the TDS deduction and paid rate as PAN not available deductee & mention PANNOTAVBL and revise the return with interest until now as TRACES rules.

Samir: The Organisation/Company is responsible to file proper TDS returns for their payments. The party will not paid return, organisation have to deduct while payment process.

One more question sunitha..

Have the organisation mentioned that party's PAN in any previous TDS returns? If YES, it's easy to find his PAN.

And if NOT, tracing the correct PAN is easy than paying Short deduction with 4-5 yrs interest. so try to get PAN.

One thing. if you can show a proof that the other party has declared that amount in their books and have paid taxes accordingly, you can make an application. We have tried this once (But on a case of disallowing an expense on account of nondeduction of TDS)
