11 December 2010Please specify the cases where one dealer can be liable to pay CST at his local rate in stead of paying 2% which is the CST rate.
One of our client is payning CST @ 5% to his supplier located at Korba ,whether he is liable to pay CST at 5% to the dealer even though he is not getting any input tax credit.

CST 2% is applicable only subject to issue of Form C. If your client in same state then no one can charge CST.
CST not to be considered as input tax credit, as this is an expenditure.
Some dealers are charging 5% as CST for following reasons :
a) The purchasing dealer is an unregistered party
b) The purchasing dealer can't issue Form C

could u pls tell me for which state CST 5% charging?
in Tamilnadu 4% of cst is charged when there is no issue of c form
or any changes or amendments issued for 5% instead of 4% in Tamilnadu?

The dealer charging 5% is from chhatisgarh
the buyer's state orissa and the buyer is a registered dealer and not issuing C FORM.

Plz any body advise can we issue Two C forms in a quarter for a single customer (by mistake c form issued partially , leaving two bills left out of ten bills)

call back the original C form issued and add two bills again, endorse the same with authorized signatures.

you have to collect fresh form from Department, c forms are come with Series - every series have value. for example
c form no. a-123456 can be issued upto bill amount rs. 10000
c form no. b-123456 can be issued upto bill amount from 10001 to 20000
