creation of HUF

Dear Nitin Kumar,

Fisrt of all HUF can not be 'created'. It comes into exitence by  happening of certin events. Like birth of  child or on marriage. In case an individual is a member of a bigger HUF and if the huf is partitioned the share of  proerty in the hands of individual becomes individual property. Later when the same individual gets married then the same property becoems his HUF property. He may not have child in that case.

In any other situation just by marriage the HUF does not come in existence.

               first of all let me tell you HUF is not created it comes into existance by birth. but for the purpose of creation of an HUF there must be an ancestral property.
under hindu suceesion act for the purpose of forming an HUF there must be two members and one of them should be male,
now in your case as there are two members and one of them is a male so they can form an HUF.
