As the term itself implies, compliance officer must first be an officer of the company. PCS is a consultant and can be authorised representative of the company in various matters before various authorities. However, he cannot be an officer of the company. [Ref. Sec. 2(59) of Companies Act 2013]. Hence the question of PCS being appointed as compliance officer does not arise.
