Commuted Family Pension received by legal heirs is not taxable in view of CBDT circular referred below:

In my opinion Family Pension cant be considered as a gratuitous payment nor as a compensation. So will the above circular will be still valid for the case i presented?

I think it should be applied as the cicular states that any payment gratiously or by way of compensation or otherwise.
