Clarification on deduction of pms fees

I understand that as per the   orders of High Court ,,Mumbai ,PMS fees paid are permissible for 

deduction from capital gain income ?  I Can we  claim this expenditure on sale of  both Long term and short term   equity shares  and debt  MFs ?
