I've paid 4% Counter Veiling Duty(CVD) while importing goods from China which I've later sold in India. I'm a dealer. Please let me know the procedure to obtain refund(or set-off) for the same.

Under customs notification 102/2007, SAD @ 4% paid on imports can be claimed refund within 1 year of filling of B/E only if that is not passed on to the buyer subsequently.
requirements:
1. bill of entry copy (original)
2. sales invoices mentioning that there is no cenvat credit passed on to the buyer or not availed credit
3. working corelating to each B/E items with the selling invoices.
4. duty challan's paid of customs duty and VAT challans
5. certificate from Auditor/chartered Accountant certifyng the correctness of the above
6. fill the refund clcim form along with all the above documents and bank details
submit within one year with the customs.
