As importers and exporters neither have the time nor the requisite knowledge of clearing imports into and exports out of the country, agents are allowed to act on their behalf under Section 146 of the Customs Act.
A custom house agent (CHA) is a person who is licensed to act as an agent for transacting any business pertaining to the entry and departure of conveyances or the import and export of goods at any customs station. This is necessitated by the highly involved and technical nature of work.
To qualify as an applicant, you need to be a graduate with and an employee of a valid Custom House Agent with experience in clearing goods through the customs for at least one year as a permanent pass-holder.
You should possess assets worth Rs 1 lakh (Rs 50,000 for some locations) certified by a scheduled bank.
A temporary one-year license is granted by the commissioner of customs (of the concerned custom station) for example, Mumbai, Kolkata, Kandla, etc, after scrutinising your application thoroughly.
The regular license, which is valid for five years will be issued upon clearing the written and oral examination (within two years), satisfying minimum volume of business and complying with the specified obligations. The exam is held twice a year.
