22 June 2015whether we can avail credit of service tax paid under reverse charge machnisam for 'Painting charges' in a works contract service after taking abatement of 60%.i.e. service tax will be applicable on 40% value and of which reverse charge applicable i.e 50%-50%.
Plz Give reference of section.

yea, you can take ccr on works contract but when there is reverse charge only after payment made to goverment you can avail

on what amount, we can take cenvat credit?
on full 12.36% or On reverse charge payble directly by the receiver i.e. 50%

If you have fulfiled the condition of notification no. 30/2012-ST then need to pay otherwise no need to pay service tax.
