yes you can claim simultaneously deduction under both sections

yes you can claim... but in my opinion, a small portion of capital gains will be charged to tax...

I am staying in India from last 8 months. I am an non resident. income tax dept are asking me to pay capital gain tax on selling of a property. is there any section in IT act under which I can give rely to them

If you are staying for more than 182 days during any financial year, you are a resident and your global income will be taxable in India including capital gains
